If a tenant does not make their required monthly rent payment,
the Corporation will begin the process to terminate the tenancy
through the Landlord & Tenant Board.
Step One: Issuing an N4 Notice to End a Tenancy Early for
Non-payment of Rent - The N4 gives the tenant a date
by which they must either vacate the unit or pay the outstanding
arrears in full. If the tenant pays the full arrears amount,
the eviction process stops. Tenants who are persistently late
in paying their rent may still be evicted.
Step Two: Opening an L1 Application - If the tenant does
not move out or pay the arrears balance in full by the date
indicated on the ‘N4', the Corporation will open an
Application Form L1. The cost of opening this Application
through the Board is $150, which is added to the tenant’s
arrears amount owing. The tenant is sent a tentative hearing
date and a dispute form. If the tenant completes the dispute
form and sends it to the ORHT, the hearing takes place on
the date indicated. At a Board hearing the tenant and landlord
are given the opportunity to mediate an agreement for payment.
An Adjudicator can also render a decision on the case. If
the tenant pays the full amount of the arrears plus the $150
fee, the Corporation will not proceed with the request to
terminate the tenancy. If the tenant does not dispute the
Application, pay the amount owing, or vacate the unit, the
Corporation may obtain an Order from the Board that can be
filed with the Enforcement Office to arrange an eviction.
Step Three: Filing an Order with the Enforcement Office
- If the tenant does not pay the arrears owing in full or
move out of the unit, then the Corporation may file the Board
Order with the Enforcement Office who will schedule an eviction
date. The costs associated with scheduling an eviction, approximately
$370, are added to the tenant’s arrears amount. The
Enforcement Office posts a notice on the tenant’s door
which states that the eviction will take place in 10 days.
If the tenant pays the full arrears amount and all other fees,
the eviction can be canceled. If the arrears and fees are
not paid in full, the eviction will take place. Locks for
the unit are changed and possession of the unit is returned
to the Corporation. Tenants have 72 hours to arrange with
the Corporation to remove any personal belongings left in
the unit. Anything left in the unit after 72 hours becomes
the property of the Corporation and may be sold to cover the
arrears amount. |
